When a Public Agency May Share Responsibility

Each of these requires its own evidence, and in most cases nobody ever investigates it.

01

Dangerous Intersection Design

A left turn with no protected arrow, sight lines blocked by vegetation or signage, a signal that was never retimed as traffic grew.

02

Road and Sidewalk Maintenance Failures

Faded lane lines, a missing or obscured stop sign, a pothole or raised slab the agency knew about and left unrepaired.

03

Freeway and Interchange Defects

Caltrans and the state are usually protected by design immunity here, but a failure to warn of a known hazard can still create liability.

04

Signal Timing and Visibility Problems

A green phase too short to clear the intersection, or a corner where overgrown vegetation or parked vehicles blocked a driver’s view.

05

A Documented History of Prior Crashes

A pattern of similar crashes at the same location is some of the strongest evidence that an agency knew, or should have known, about the condition.

06

Government Vehicles and Employees

A city vehicle, a transit bus, or a public employee acting within the scope of their job can also create a direct claim against the agency.

Protect your claim

What to Do If You Suspect the Road Was a Factor

The clock on a government claim is shorter than people expect, and most of these steps have to happen before it runs out.

01

Photograph the intersection

Sight lines, striping, signage and lighting change fast. Document the corner the way it looked the day of your crash.

02

Find out who owns the road

A city street, a county road and a state highway each go to a different claims office. Filing with the wrong one does not stop the clock.

03

Request the city’s own records

Prior complaints, traffic studies and maintenance logs are public record and are often the strongest evidence that the agency knew.

04

Do not wait on your medical bills to decide

The six month deadline runs regardless of whether you know your final injury total.

05

Present a claim to every agency that might apply

Unsure whether it was the city or the state? Present to both. A claim can be withdrawn. A missed deadline cannot be undone.

06

Call us before the window closes

We can tell you quickly whether the facts support a claim and get it filed before the deadline runs.

Compensation When a Public Agency Shares Responsibility

California treats medical bills and lost income differently from pain and suffering once more than one defendant is involved, and that difference usually decides the case.

Frequently Asked Questions

Can I sue the City of Los Angeles after a car accident?
Yes, if a dangerous condition of public property contributed to your crash and the city knew or should have known about it. The crash happening on a city street is not enough by itself; the condition itself has to have played a role.
How long do I have to file a claim against the city or the state?
Six months from the date of the crash to present a written claim to the responsible agency, under Government Code §911.2. That is far shorter than the two year deadline for an ordinary claim against a driver, and it runs regardless of your medical treatment.
What is the difference between suing a driver and filing a government claim?
A driver’s insurance is capped at their policy limit. A public agency is not insured the same way, and California’s joint and several rule means an agency found even partly responsible can be liable for the entirety of your medical bills and lost income.
Can I still bring a government claim if I already have a lawyer for the driver?
Yes. We regularly evaluate the public agency angle on cases another firm is already handling against the driver, and the two claims can proceed at the same time.
Do I need an expert to win a case against the city?
Usually. These cases generally require a traffic engineer willing to say a condition was substandard, which is why we review the facts carefully before committing to one.
